Terms of Service

1. Eligibility and Professional Standing

By registering as a practitioner, you represent and warrant that:

• You are legally permitted to offer the services you list on your profile in the jurisdiction(s) in which you practice
• You hold any and all licenses, certifications, training, or qualifications that are required, recommended, or customarily expected for the services you offer, and that you provide only those services for which you are appropriately trained and, where applicable, licensed
• All information provided in your profile, including your credentials, qualifications, experience, and services offered, is accurate, current, and not misleading
• You will promptly update your profile if any of the above information changes, including if a license or certification lapses, is suspended, or is revoked

MotherMind relies on the accuracy of the representations you make at registration and on an ongoing basis. MotherMind does not independently verify practitioner credentials, licenses, or qualifications, and does not guarantee or warrant the quality, safety, or appropriateness of any services offered by any practitioner. Mothers using the platform are encouraged to conduct their own due diligence before engaging any practitioner's services, and this is reflected in the disclaimer shown on every practitioner's public profile.

2. Your Profile and Areas of Specialization

You are responsible for maintaining the accuracy of your profile, including your listed services, areas of specialization, professional title, biography, Signature Advice content, location, languages, and availability status. You may update this information at any time through your MotherMind app, and you agree to do so promptly when your circumstances change, including changes to your availability for new clients or the services you are currently able to offer.

You agree not to misrepresent your qualifications, the nature of your services, or your availability at any time.

3. Community Standards and Conduct

As a condition of participating in The Healing Circle, you agree to comply with MotherMind's Community Standards, which include the following obligations:

• You will comment on articles and engage in the MotherMind community only with the intention of supporting and validating mothers, not for the primary purpose of promoting your own services
• You will not contradict, dismiss, or minimize a mother's lived experience in any comment, reply, or community interaction
• You will not post negative, dismissive, or judgmental comments regarding any emotional content shared by mothers
• You will maintain a professional, warm, and respectful tone in all interactions on the MotherMind platform
• You will represent your qualifications and services honestly and accurately at all times

MotherMind takes these standards seriously because the platform serves a vulnerable population of new and expectant mothers, and the trust of our community depends on practitioners upholding them.

4. No Unsolicited Solicitation

You agree that you will not use any information or access obtained through the MotherMind platform to contact, message, solicit, advertise to, or otherwise market your services to any mother who has not first initiated contact with you. This includes, without limitation, sending unsolicited direct messages, attempting to obtain a mother's contact information through indirect means, or using the platform's comment or community features as a vehicle for self-promotion rather than genuine, supportive engagement.

Where direct messaging is available within the MotherMind app, practitioners may only respond privately to a mother who has messaged them first. Practitioners may, however, respond publicly to a mother's comment on an article at any time, provided such responses comply with the Community Standards described above.

Violation of this section is treated as a serious breach of these Terms and may result in immediate suspension or termination of your practitioner account, in addition to the reporting and warning process described in Section 5 below.

5. Reporting, Warnings, and Removal

Other users of the MotherMind platform may report any comment, insight, or interaction that they believe violates these Terms or the Community Standards. MotherMind reserves the right to review, hide, or remove any practitioner comment or content at its discretion.

Where a practitioner comment receives a sufficient number of community reports, or where MotherMind otherwise determines that these Terms or the Community Standards have been violated, the following process applies:

• A first violation will result in a formal written warning sent to the practitioner's registered email address
• A second violation will result in permanent removal from The Healing Circle, immediate unpublishing of the practitioner's profile, and cancellation of the practitioner's subscription
• MotherMind reserves the right to skip the warning process and immediately suspend or terminate a practitioner account in cases of serious misconduct, including but not limited to unsolicited solicitation, harassment, misrepresentation of credentials, or any conduct that endangers the safety or wellbeing of a MotherMind user

No refund will be issued for any remaining subscription period following removal from The Healing Circle under this section, regardless of the reason for removal.

6. You May Also Report and Block

Practitioners are entitled to the same protections as any other MotherMind user. If you experience harassment, abusive conduct, or any behaviour from a user that violates MotherMind's general Terms of Service, you may report that user and, where the feature is available, block further contact from that user. MotherMind will review such reports in accordance with our standard moderation process.

7. Subscription, Fees, and Billing

Participation in The Healing Circle requires an active paid subscription, billed monthly through our payment processor (Stripe). Current standard pricing is $9.95 USD per month. MotherMind may, at its discretion, offer a discounted introductory or "Founding Practitioner" rate to a limited number of early-registering practitioners; where offered, the specific terms of any such rate (including its duration and conditions for retention) will be disclosed at the time of registration.

• Subscriptions renew automatically each month unless cancelled by the practitioner prior to the renewal date
• Practitioners may cancel their subscription at any time through their MotherMind app; cancellation will take effect at the end of the current billing period, and no partial-month refunds are issued
• If a practitioner cancels and later resubscribes, any previously held discounted or Founding Practitioner rate is not retained, and the then-current standard rate will apply
• MotherMind reserves the right to change subscription pricing prospectively, with reasonable notice provided to practitioners in advance of the change taking effect

8. Independent Contractor Relationship

Practitioners are independent professionals and are not employees, agents, contractors, partners, or representatives of MotherMind. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between MotherMind and any practitioner. MotherMind does not direct, supervise, or control the manner in which practitioners provide their services to clients, and is not a party to any agreement, financial arrangement, or relationship between a practitioner and a mother who engages their services.

9. Disclaimers and Limitation of Liability

MotherMind provides The Healing Circle as a directory and discovery tool only. MotherMind does not endorse, recommend, vet, or guarantee any particular practitioner, and does not warrant the quality, suitability, safety, legality, or outcome of any services provided by any practitioner listed on the platform. The disclaimer displayed on every public practitioner profile reflects this position and is a material term of these Terms.

To the fullest extent permitted by law, MotherMind disclaims all liability arising from or relating to services provided by practitioners to mothers, including any dispute, claim, injury, or damage arising from such services. Practitioners agree to indemnify and hold MotherMind harmless from any claims arising from the services they provide.

10. Modification and Termination

MotherMind reserves the right to modify these Terms at any time. Material changes will be communicated to practitioners by email or through the MotherMind app, and continued participation in The Healing Circle following such changes constitutes acceptance of the revised Terms. MotherMind also reserves the right to suspend or discontinue The Healing Circle, in whole or in part, at its discretion, with reasonable notice to practitioners where practicable.
